It is possible to switch from one category of the immigration rules to another if the immigration rules permit. The law and policy regarding who can switch their status and who cannot is complex and we strongly recommend that those considering switching status seek legal advice before submitting an application. For instance,  a common concern of the BIA will be whether the attempt to change one’s immigration status shows an individual had deceived the immigration authorities with regards to their true intentions when first seeking to come to the UK. Such misunderstanding by a decision-maker can result in individuals being served a “notice of illegal entry” on grounds of deception.
